- 1. LEGISLATION.
Tourist rentals are regulated by the legislation of Catalonia in the field of tourism, and more specifically by Decree 159/2012 of November 20.
2. AGREEMENT AND MODIFICATIONS.
The conditions listed below are an agreement between the client and the owner of the house/apartment.
Port Blanc Costa Brava SL acts as an intermediary and is responsible for the proper execution of mediation, which is performed in accordance with the existing legislation.
These general terms and conditions are governed by, interpreted and applied in accordance with Spanish Girona (Spain).
By using the Port Blanc Costa Brava SL website, making a reservation through this website or at the Port Blanc Costa Brava SL office, the client declares that he has read these terms and accepts them.
These terms and conditions may be changed in order to improve the quality of the services provided.
3. TERMS OF BOOKING AND PAYMENT.
- The client can book an apartment or a house by phone, via the Internet or in person in our office.
- To do this, you need to make a payment in the amount of 20% of the rental price.
- Within the next 24 business hours, the customer will receive a booking confirmation via email with the booking and payment status.
- On the day specified in the reservation (depending on the season), guests must pay the remaining amount (by card or bank transfer).
Payment method:
- Bank transfer (no later than 3 days before arrival).
- Cash.
- Credit card (online, by phone or in person at the office).
In case of booking through third parties (travel agents, tour operators or other employees authorized by Port Blanc Costa Brava SL), their payment terms apply.
4. MANDATORY EXPENSES NOT INCLUDED IN THE PRICE.
SECURITY DEPOSIT.
The following expenses are not included in the rental price and are mandatory:
— Tourist tax (1 € per day for each person over the age of 16, but not more than 7 days).
— Final cleaning (the amount of sum for cleaning depends on the accommodation – from 40 € to 200€, indicated in the booking form before payment).
While checking in, the customer must provide their credit card details as a security deposit.
The Client authorizes Port Blanc Costa Brava SL to withdraw from his credit card, even after his departure, amounts for any damage caused by him or any of his companions in the rented house or apartment.
The data of this card will be deleted from the database after checking the placement after the customer’s departure.
No amount is charged from the card, except in cases when defects are found in the accommodation, furniture or equipment, as well as in cases of heavy dirt and debris.
The cost of restoring the previous condition will be withdrawn from the credit card.
Also, the security deposit can be taken in cash on the day of arrival and returned on the day of departure, after checking the condition of the accommodation.
5. CHANGES IN PRICES, SERVICES, PHOTOS.
Although the descriptions of apartments/houses and their prices have been carefully prepared, they may still be subject to changes at some point, which will be notified at the time of booking and subsequently confirmed in writing.
It is also possible that such changes will occur after booking confirmation and will affect the main provisions of the contract.
In this case, the client can terminate the contract within five days, and he will be reimbursed for the entire amount paid by him.

Interior decoration may vary.
6. MINIMUM STAY DURATION, DAY AND TIME OF ARRIVAL/ DEPARTURE, MAXIMUM NUMBER OF PEOPLE.
The minimum stay duration depends on each property and on the season and can vary from one night to seven nights.
This information can be found on the Port Blanc Costa Brava SL website, it can also be obtained by phone or email.
Check-in time: from Monday to Sunday from 15:00 until 20:00, and check-out time until 11:00 in the morning.
Arrivals after 20:00 have an additional cost of 20 euros.
Departure time: the client agrees to leave the accommodation free and return all keys before 11 am on the day of departure.
If the accommodation is not vacated, the client will be obliged to pay the double amount of the contract daily and will also be obliged to compensate for damage that may be caused to other people with a confirmed reservation.
Check-in and getting keys c take place in the rented accommodation at the time of arrival.
The maximum number of people who can be accommodated in each specific property is limited and specified in each specific description.
The owner responsible for the keys and/or a representative of the Port Blanc Costa Brava SL may prohibit access if the maximum number of people is exceeded.
7. CANCELLATION OF THE RESERVATION.
If the guest cancels the reservation 24 hours after the first payment, the cancellation will be free of charge and 100% of the amount paid will be refunded.
If the guest cancels the reservation from the day after the first payment is made up to 60 calendar days before the arrival date, the cancellation fee will be 20% of the total rental amount.
If the guest cancels the reservation within 60 calendar days before the arrival date or does not arrive on the day of check-in, the cancellation fee will be equal to 100% of the rental price.
Cases of non-refund
In case of any serious unforeseen circumstances, Port Blanc Costa Brava SL reserves the right to withdraw from the contract within 24 hours after the completion of the first payment by the client, reimbursing the amount paid.
In case of force majeure, Port Blanc Costa Brava SL reserves the right to replace the reserved accommodation with other accommodation with similar characteristics or cancel the reservation if the guest prefers a refund of the amount paid.
In case of booking through third parties (travel agencies, tour operators or other intermediaries authorized by Port Blanc Costa Brava SL), their cancellation policy applies.
8. OBLIGATIONS OF THE CLIENT AND RULES OF ACCOMMODATION.
Leave the apartment or house, as well as furniture (inside and outside) clean and in good condition (dishes and kitchen utensils must be clean, garbage must be in appropriate containers outside the apartment/house, there should be no damage on the internal and external walls of the apartment/ house, windows, doors, a pool), and in case of damage or breakage, it will be the responsibility of the client to pay compensation for the cost of replacement or repair.
If kitchen appliances or dishes (cutlery, plates, glasses, for example) are broken, the guest is obliged to replace them with the same or similar ones during his stay in the apartment or house.
Or report it to Port Blanc Costa Brava SL and pay the cost of damaged items.
It is prohibited to carry out harmful to the health of others, dangerous or illegal activities in the apartment / house that violate the rights and interests of neighbors,.
It is forbidden to store combustible, explosive materials, as well as to develop commercial or industrial activities.
Do not re-rent the apartment / house to third parties, do not transfer the keys and the contract.
Observe the internal regulations, charters and rules that are provided for in common areas that are part of the community of owners.
Do not make noise, especially after 22:00.
You are to allow representatives of Port Blanc Costa Brava SL to visit the apartment / house during working hours, with persons interested in buying this property (only if the housing is for sale).
The number of visits cannot exceed two per week, the time of visits is agreed in advance with the tenants.
Notify Port Blanc Costa Brava SL of any damage that may occur in the apartment / house for the purpose of quick repairs, as well as allow a specialist of Port Blanc Costa Brava SL to enter the house/apartment at any time, and do not perform independent repairs and not hire outsiders.
Otherwise, the damage that these actions may cause is to be fully paid by the client.
Allow the gardener and pool care professional to do their job of maintaining and watering the garden and pool.
To prevent theft, do not leave personal belongings outside (on the terrace or in the garden), as well as close doors and windows when leaving the house / apartment.
The insurance policy covers the house/apartment, but not the personal belongings of the clients.
The client assumes responsibility for the safety of housing, furniture and equipment, and undertakes to leave them in the same condition when leaving.
The Client undertakes to inform Port Blanc Costa Brava SL of any damage that may occur in the accommodation for the purpose of quick repairs, and also undertakes to give an access to the rented accommodation to a technician sent by Port Blanc Costa Brava SL at any time agreed with the client.
It is strictly forbidden to do the repairs oneself or with the help of other people.
Otherwise, the damage that this violation may cause will be the responsibility of the client.
9. CLEANING.
The accommodation will be provided to the client clean.
The client undertakes to leave the accommodation in acceptable condition without garbage and food residues.
Otherwise, the client will be fined 100 euros.
10. COMPLAINTS.
In the event that a client wants to leave a complaint or a suggestion, he can do it by e-mail or by phone Port Blanc Costa Brava SL, listed on the website.
11. DUTIES OF Port Blanc Costa Brava SL.
If the reserved accommodation has serious disadvantages that prevent its normal use, Port Blanc Costa Brava SL undertakes to find alternative accommodation with similar characteristics and price.
If this is not possible due to the lack of available accommodation, or because the client rejects all offers, all or part of the rental amount will be refunded to the client.
The responsibility of Port Blanc Costa Brava SL is limited to its role as an intermediary and does not include any other responsibility of the owner of the apartment/ house.
Port Blanc Costa Brava SL does not bear any responsibility in the following cases:
Negligence or omission of third party services.
Malfunctions of swimming pools, playgrounds, and sports facilities of any kind.
Their use is also the responsibility of the user.
Theft in residential premises.
Damage caused to people or property as a result of force majeure or unforeseen situations.
In any case, the economic liability of Port Blanc Costa Brava for any moral damage that may arise as a result of intermediary activities is limited to the amount paid for the lease.
12. PERSONAL DATA.
The Client gives his consent to the inclusion of his personal data in the Port Blanc Costa Brava SL data system.
The purpose of processing this data is to properly manage your booking.
Unless otherwise specified, the data may be used to send information about the goods and services of Port Blanc Costa Brava SL, for which electronic means may be used.
If the customer has made a reservation through the intermediary of a travel agency or a partner company, his data may be transferred to them for verification.
In any case, the client can exercise his right to correct or delete his data by contacting Port Blanc Costa Brava SL.
